Thomas J. Schell

Thomas Schell has litigated in various areas, including general commercial litigation, bankruptcy, patents, trademarks, copyright, securities and related fraud, accounting malpractice, RICO, partnership law, employment law, and real estate. He has successfully tried cases in federal court and has successfully argued numerous motions in federal and state courts.

In In re The Cassandra Group, a bankruptcy case involving a debtor whose principal was called the “financial advisor to the stars,” Mr. Schell has helped litigate, on behalf of the trustee, about 100 adversary proceedings, the defendants in which included several entertainment celebrities. Through numerous successful proceedings and settlements, he has helped the trustee to recover millions of dollars and to make distributions that have paid off a substantial amount of the allowed creditors’ claims. In another bankruptcy case, Mr. Schell helped defend former shareholders of the debtor in various proceedings, including three successful appeals that led ultimately to a successful settlement of a multi-million dollar fraudulent transfer action. Mr. Schell also participated on one of the committees in a large joint defense group in the Lemelson Foundation’s patent litigation against retailers.

Mr. Schell’s practice also extends beyond litigation to corporate compliance and patent prosecution and advice. He has helped lead a team of attorneys and forensic accountants in a company’s internal investigation of transactions involving complex financial derivatives, and helped prepare a detailed report for submission to the Securities and Exchange Commission. A registered patent attorney, he has been involved in prosecuting patent applications and providing advice to clients on patents and other intellectual property issues.

A member of the firm’s Electronic Discovery Unit, Mr. Schell is active in helping clients keep up with the rapid changes in electronic discovery and other technological issues that arise in litigation. He has made presentations to clients on the amendments to the Federal Rules of Civil Procedure concerning e-discovery. He also has consulted with clients and other litigation teams regarding various e-discovery issues.
