Timothy P. Fraelich

Tim Fraelich's primary area of practice involves trademarks, including trademark infringement and dilution, trade dress protection, unfair competition, deceptive trade practices, and right of publicity law. Tim has more than 21 years of experience in global trademark clearance, brand development, portfolio management, and client counseling. He has represented clients in courts throughout the U.S. and before the Trademark Trial and Appeal Board (TTAB) on numerous occasions. Additionally, Tim frequently drafts and enforces post-employment noncompetition covenants designed to protect the confidential information and trade secrets of clients.

Tim has been involved in recent cases concerning trademarks for a diverse variety of products, including banking services, retail stores, restaurant services, appliances, video games, fertilizer, magazines, toys, cutlery, software, and a variety of other products and services. He acts as primary outside trademark counsel for the H. J. Heinz Company, The J.M. Smucker Company, Bravo/Brio Restaurant Group, Hamilton Beach Brands, and Prizer-Painter Stoveworks, and he assists those companies in registering, protecting, and enforcing their many famous trademarks. . He maintains trademark porfolios for his clients that consist of many thousands of trademarks registered throughout the world.

Tim is a member of the International Trademark Association. He has been designated an "Ohio Super Lawyer" in the field of intellectual property litigation for 2005 - 2007, 2011 and 2012. Tim has also been recognized as one of the World's Leading Trademark Professional of 2014 by the respected World Trademark Review publication. Tim sits on the board of the Greater Cleveland Council of the Boy Scouts of America.
