Timothy S. Harris

Tim is a member of the Financial Industry Group, practicing in the area of Commercial Restructuring & Bankruptcy. Tim represents creditors faced with insolvency issues. He represents primarily secured and unsecured creditors in work-out, litigation, and bankruptcy situations. For nearly twenty years, Tim has represented creditors in restructuring debt, recognizing that restructuring by agreement is often more beneficial to creditors than suing. He also represents those same creditors in litigation in the event these restructuring efforts fail. Often this litigation leads to bankruptcy, where Tim continues his representation of creditors by enforcing their rights in the bankruptcy context.

Tim’s restructuring experience is widespread. He has represented equipment lenders in restructures involving printing facilities, food processing operations, and tool and dye manufacturers. He has represented factors in all aspects of the restructuring of their financially troubled customers.

Tim’s litigation experience is equally expansive. Tim has successfully prosecuted dozens of replevin proceedings in dozens of U.S. jurisdictions. He also has successfully prosecuted dozens of lawsuits seeking and gaining temporary restraining orders and other forms of injunction. He has conducted and won dozens of trials, both bench and jury. He has conducted and won several appeals growing out of these trials, including appeals both to state and federal courts of appeal.

Tim’s bankruptcy experience has involved representing both secured and unsecured creditors. Tim is intimately familiar with the bankruptcy laws, and has represented creditors in dozens of bankruptcy proceedings around the U.S., including motions to lift stay, motions challenging the actions of the trustee, and preference defense.

In addition, Tim has represented publicly traded corporations in both complex and straight-forward contract litigation. He has guided clients to success through both settlement and trial. He has also represented clients when they are sued in a business dispute.

Tim’s practice continues to involve both bread-and-butter litigation and creditors’ rights enforcement, as well as complex and sophisticated litigation and bankruptcy representation. He is always looking forward to the newest challenge and looking for ways to best represent the interests of the client in a cost-effective manner.
