Mr. Galante has represented secured creditors (including various banks, credit unions, insurance companies, title insurance companies, lessors, bondholders, indenture trustees, joint venture groups and individuals), franchisors, franchisees, unsecured creditors’ committees, special interest committees, unsecured creditors, debtor companies and individual debtors in Chapter 11, 13 and 7 bankruptcy cases. He has defended numerous adversary proceedings in bankruptcy court for clients addressing myriad issues. Mr. Galante has also represented purchasers of assets in bankruptcy and other creditor proceedings, as well as clients in matters involving assignments for the benefit of creditors, receiverships, appointments of special fiscal agents, debt collection, out-of-court workouts and restructurings, real estate and UCC foreclosures, replevin, lender liability, mortgage warehousing, ponzi scheme, fraud, embezzlement matters and insurance claims. Mr. Galante has represented and/or counseled both franchisors and franchisees in bankruptcy cases and related proceedings in federal and state courts. These include, but are not limited to, assumption and assignment of franchise agreements, contested franchise termination, alleged fraud and breach of contract cases, enforcement actions as well as franchise asset sales. His franchise experience is in both automobile and non-automobile/retail franchises.
