Todd S. Holbrook

Todd S. Holbrook is a partner in Morgan Lewis's Litigation Practice. Mr. Holbrook provides commercial litigation services nationally to a range of businesses and individuals in patent, trademark, trade dress, trade secret, copyright, toxic tort, insurance coverage, and general litigation.

Mr. Holbrook has also had a particular interest in electronic commerce and digital technology litigation since pursuing one of the first civil lawsuits in the nation by a securities trading company suing an individual under the Computer Fraud and Abuse Act for hijacking the company's computer network.

Mr. Holbrook tries patent cases brought in Massachusetts state and federal courts on behalf of national and global high-tech businesses. He counsels major tech manufacturers and entrepreneurial start-ups in the U.S. and abroad on a full range of key commercial issues, such as software development, licensing, and contracting matters, as well as avoiding trial and resolving commercial disputes out of court. In addition, Mr. Holbrook enjoys counseling a variety of non-tech businesses on issues tied to their use of technology, including digital communications and electronic commerce.

Mr. Holbrook has been named one of the leading U.S. lawyers for commercial litigation by Chambers USA, and was named a Massachusetts SuperLawyer in 2009 and 2011–2013.

Mr. Holbrook has spoken before the American Bar Association, the Maine State Bar Association, the Electronic Commerce Forum of Maine and other groups on subjects related to litigation, intellectual property, electronic commerce, and issues facing businesses using new technologies. He is a past co-chair of the Trademark Litigation subcommittee of the ABA's Litigation Section and is co-editor of the ABA Model Jury Instructions Manual for Copyright, Trademark, and Trade Dress Cases on non-patent intellectual property litigation.

Mr. Holbrook has been active as a civic volunteer on planning boards and as zoning advisor in several communities where he has lived.

Prior to joining Morgan Lewis, Mr. Holbrook was a partner at a Northern New England law firm. He also served as a law clerk to Chief Justice Daniel E. Wathen of the Maine Supreme Court.

Prior to attending law school, Mr. Holbrook earned his M.A. in physics, which serves as a strong technical foundation for analyzing, interpreting, and presenting complex technology matters in briefs and oral arguments at trial. This technical background is also an advantage in his role leading the firm's New England representation of a multinational corporation facing mass asbestos torts.

Mr. Holbrook is admitted to practice in Massachusetts, Rhode Island, and Maine and before the U.S. District Courts for Massachusetts, Maine, and Rhode Island and the U.S. Courts of Appeals for the First, Third, and Federal Circuits.
