Trevor J. Welch

Trevor J. Welch is a litigator with a broad-based civil practice, focusing on complex commercial litigation and appellate work. Trevor has represented plaintiffs and defendants in a wide variety of cases involving, among other things, breach of fiduciary duty claims, business torts, structured financial products, products liability, constitutional issues and discrimination claims.

Among other representations, Trevor acted as trial counsel to an investment partnership in a two week jury trial against a public accounting firm for aiding and abetting breaches of fiduciary duty to the public preferred shareholders of the audited company. Trevor was also appellate counsel to the investment partnership in the accounting firm’s appeal of the jury’s verdict.

Trevor also represented a real estate developer in obtaining a rare reversal of a taking of property in violation of the Fifth Amendment on the grounds that it “was not for a public purpose but principally conferred a private benefit” on a favored citizen. Trevor also acted as appellate counsel to the developer in the appeal of the order setting aside the taking. Trevor currently represents ACA Financial Guaranty Corporation in an action against Goldman Sachs & Co. for fraud in connection with the now-notorious CDO known as Abacus 2007-AC1. In this action, ACA alleges that Goldman structured and marketed ABACUS based on a portfolio of investment securities selected largely by its hedge fund client, Paulson & Co. Inc. ACA further alleges that Goldman fraudulently induced it to provide guaranty insurance for ABACUS by deceiving ACA into believing that Paulson also was to be a long investor in ABACUS when in fact, as Goldman knew, Paulson intended to take an enormous short position in ABACUS, reaping nearly $1 billion when the portfolio failed. Trevor has successfully represented clients in a variety of appellate matters, ranging from constitutional to procedural issues, including in the U.S. Courts of Appeal for the Second and Ninth Circuits, as well as New York, Virginia and Maryland appellate courts.
