W. Gordon Dobie serves as lead partner in trial court and appellate cases throughout the United States with a focus on business torts and fraud, including contract, antitrust, unfair competition, RICO, and securities litigation matters. He represents leading corporations and corporate executives worldwide. His high-stakes complex commercial litigation experience also includes class actions – he is a veteran of more than 50 – as well as international arbitration matters.

Won $500 million award on behalf of former chairman of major coal company in scorched-earth litigation battle where Mr. Dobie prevailed through six contested appeals and 27 motions. As lead counsel, defeated all of defendant’s substantive and procedural defenses, obtained preliminary injunctions to prevent collateral litigation, and effectively managed worldwide dispute towards great client victory and 27-0 record. The matter has garnered worldwide media attention.
Lead counsel for Southern Marketing Agency (an alleged 65% market share participant) in the MDL antitrust case In re Southeast Milk Antitrust Litigation, where he obtained summary judgment for defendant in indirect purchaser antitrust class action with the other defendants marching towards trial or settlement.
Won judgment of “not guilty” from Delaware Chancery and Delaware Supreme Court for directors/officers of a casino corporation faced with claims of breach of fiduciary duty arising from the $609 million sale of casinos.
Currently representing Solyndra LLC and Energy Conversion Devices in a billion-dollar antitrust litigation against three Chinese solar manufacturers that dumped solar panels in the United States and that are alleged to have driven American solar companies out of business. Prevailed in hotly contested motion to dismiss filed by three Am Law 50 law firms against Solyndra’s claims, with parties now proceeding towards trial. This case and win have also received extensive U.S. press coverage.
Recently won dismissal of a case seeking hundreds of millions of dollars from European Bank employees and an off-shore entity. Presented case at trial court and in argument before the U.S. Court of Appeals for the Second Circuit, which affirmed the dismissal of the claims of fraud and conversion of allegedly millions of dollar of assets.
Obtained $350 million recovery for a group of bondholders in the WorldCom case whose bankruptcy claims had previously been rejected.
Lead counsel for a group of sophisticated investors in litigation against off-shore banks involved in an elaborate international Ponzi scheme. Recovery of a $330 million RICO judgment in the United States and obtained international court recognition.
Successful prosecution at trial court and Delaware Supreme Court requiring indemnification and advancement in connection with a billion-dollar securities/RICO action brought against the former chairman and CEO of a publicly traded corporation.
Won summary judgment for multinational pharmaceutical corporation in a certified class action alleging that the defendant had monopolized a multibillion-dollar pharmaceutical market.
Represented former subsidiary of Gazprom in connection with litigation arising from the bankruptcy by Yukos oil company seeking to halt the sale at auction of Yuganskneftegaz by the Russian government. The Yukos bankruptcy case, which would have been the largest in U.S. history, was dismissed.
Won dismissal of securities and RICO claims by former Yukos stockholders against Gazprom and other Russian defendants alleged to have expropriated billions in assets from Yukos stockholders (also prevailing in Yukos’ U.S. bankruptcy case).
Successful defense of pharmaceutical company alleging mass tort and individual actions alleging that the product was defective and caused death and injury.
Co-lead counsel in a tax lawsuit against the State of Florida. Following trial court and Florida Supreme Court rulings, clients received full recovery—$188.1 million.
Obtained judgments of no liability for a professional-services firm in the defense of numerous securities class action lawsuits.
Represented former chairman of a large publicly traded corporation against the company’s allegations of fraud and breach of fiduciary duty, which involved a five-week trial that ended in a settlement in which the corporation dismissed the claim with prejudice and made payments to the chairman.
Mr. Dobie received a B.A., cum laude, from Boston University in 1982. He received a J.D. from Washington University in 1986, where he was awarded the Roos Scholarship for academic excellence, served as managing editor of the Washington University Law Quarterly, and was elected to Order of the Coif.
