William J. Delany is a partner in Morgan Lewis’s Labor and Employment Practice. His practice focuses on the defense of ERISA class action and complex employment discrimination lawsuits. Mr. Delany has experience in defending class action claims challenging the administration of 401(k) savings plans, “stock drop” litigation, and breach of fiduciary duty claims arising out of the modification and/or termination of retiree medical and other employee benefit plans. Mr. Delany regularly defends employee benefit plan administrators and trustees against breach of fiduciary duty and other ERISA claims.
Mr. Delany also represents employers in a variety of labor and employment–related matters in U.S. state and federal courts and before numerous state and federal agencies, including the National Labor Relations Board, the Equal Employment Opportunity Commission, the Pennsylvania Human Relations Commission, the Pennsylvania Labor Relations Board, and the New Jersey Division on Civil Rights. Mr. Delany has represented clients in matters involving executive employment disputes, noncompete agreements and restrictive covenants, and employment discrimination claims as well as in traditional labor matters involving the labor-management relationship and disputes involving individual employee rights. Mr. Delany also counsels employers regarding executive misconduct and fraud investigations.
In 2007, Mr. Delany was named an "up and coming" lawyer for employment law by Chambers USA, based on the views of clients, peers, and other industry professionals. Chambers noted that Mr. Delany "wins accolades from clients as tremendously proactive at working to improve employee relations."
Mr. Delany is admitted to practice in the District of Columbia, Pennsylvania, and New Jersey and before the U.S. Court of Appeals for the Third Circuit and the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania, the Eastern District of Michigan, and the District of New Jersey.
