This Spousal Consent can be used for various agreements, such as Partnership Agreements, Shareholder Agreements, and Limited Liability Operating Agreements, Buy-Sell Agreements, etc.   It is a general spousal consent in which the spouse agrees to be bound by all of the terms of the agreement to which the other spouse is a party.

With a Spousal Consent, the spouse which is not a party to the underlying agreement or contract, agrees to be bound by the language of that underlying agreement.  For example, a shareholder agreement may require that the shares of a deceased shareholder be sold to the remaining shareholders.  Without a spousal consent, the spouse of the deceased shareholder could object to such a forced sale. A spousal consent will prevent the surviving spouse from raising a valid objection.

Another example is in a buy-sell agreement, where one spouse sells his or her partnership interest to another partner.  Because the spouse of the selling partner may have a spousal interest in that partnership interest, the purchasing partner should require that the spouse sign a consent to the sale.  This spousal consent can be used for that purpose.
